Appellate Division Holds Marlboro Subject to Builder’s Remedy Litigation
August 17, 2015In Timber Glen v. Township of Hamilton (August 6, 2015 published decision), the Appellate Division agreed with apartment building owners and held that Hamilton Township’s (Atlantic County) licensing ordinance is “invalid as ultra vires and unenforceable.” Pursuant to the NJ Licensing Act, the court limited municipalities’ licensing authority to commercial and residential rentals with leases of less than 175 days. As amicus in support of Timber Glen, NJBA had participated in Appellate Division oral arguments on April 20, 2015.
